  1. END-USER LICENSE AGREEMENT
  2.  
  3. IMPORTANT-READ CAREFULLY: This End-User License Agreement ("EULA") is
  4. a legal agreement between you (either an individual or a single
  5. entity) and Brayder Technologies, Inc. ("Brayder") for the software
  6. JackFlash, which includes computer software and may include associated
  7. media, printed materials, and "online" or electronic documentation
  8. ("SOFTWARE").  By exercising your rights to make and use copies of the
  9. SOFTWARE, you agree to be bound by the terms of this EULA.  If you do
  10. not agree to the terms of this EULA, you may not use the SOFTWARE.

  12. LICENSE
  13.  
  14. 1.    GRANT OF LICENSE.
  15.  
  16. This EULA grants you the following rights:
  17.  
  18. a)    You may install and use only one copy of the SOFTWARE at any 
  19.     given time.
  20.  
  21. b)    You may not reproduce or distribute copies of the SOFTWARE.
  22.  
  23. c)    Decompilation, and Disassembly.  You may not reverse engineer,
  24.     decompile, or disassemble the SOFTWARE, except and only to the 
  25.     extent that such activity is expressly permitted by applicable 
  26.     law notwithstanding this limitation.
  27.  
  28. d)    The SOFTWARE is licensed as a single product.  Its component 
  29.     parts may not be separated for use on more than one computer.
  30.  
  31. e)    You may transfer all of your rights under this EULA, provided 
  32.     the recipient agrees to the terms of this EULA.
  33.  
  34. f)    Without prejudice to any other rights, Brayder may terminate 
  35.     this EULA if you fail to comply with the terms and conditions
  36.     herein.  In such event, you must destroy all copies of the
  37.     SOFTWARE and all of its component parts.

  40. 2.    COPYRIGHT.
  41.  
  42. The SOFTWARE is protected by copyright laws and international
  43. copyright treaties, as well as other intellectual property laws and
  44. treaties.  All title and copyrights in and to the SOFTWARE (including
  45. but not limited to any images, photographs, animations, video, audio,
  46. music and text incorporated into the SOFTWARE), the accompanying
  47. printed materials, and any copies of the SOFTWARE are owned by
  48. Brayder.

  51. 3.    LIMITED WARRANTY.
  52.  
  53. a)    NO WARRANTIES.
  54.     Brayder expressly disclaims any warranty for the SOFTWARE.
  55.     The SOFTWARE is provided "as is" without warranty of any kind,
  56.     either express or implied, including, without limitation, the
  57.     implied warranties of merchantability, fitness for a
  58.     particular purpose, or noninfringement.  The entire risk
  59.     arising out of use or performance of the SOFTWARE remains with
  60.     you.

  62. b)    NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
  63.     In no event shall Brayder or its suppliers be liable for any
  64.     damages whatsoever (including, without limitation, damages for
  65.     loss of business profits, business interruption, loss of
  66.     business information, or any other pecuniary loss) arising out
  67.     of the use of or inability to use the SOFTWARE even if Brayder
  68.     has been advised of the possibility of such damages.  Because
  69.     some states/jurisdictions do not allow the exclusion or
  70.     limitation of liability for consequential or incidental
  71.     damages, the above limitation may not apply to you.

  73. c)    NO LIABILITY FOR ERRORS OR OMISSION.
  74.     Brayder expressly disclaims any liability for errors or
  75.     omissions in the content of the SOFTWARE.
  76.  
  77. 4.    RESERVATIONS.
  78.  
  79. All rights to the SOFTWARE not expressly granted herein are reserved
  80. by Brayder.

  82. 5.    MISCELLANEOUS
  83.  
  84. This EULA shall be governed and construed inaccordance with the laws
  85. of the province of Ontario, Canada and shall benefit Brayder, its 
  86. successors and assigns.
